El propósito de este trabajo es presentar tres modelos con los que dentro de nuestra tradición, la latinoamericana, se han pensado las reglas sobre matrimonio, divorcio y paternidad. Considering that culture is the product of creative and human processes, it is believed that intellectual property is a legal tool that allows for its protection given that it helps conserve, safeguard and preserve its tangible and/or intangible assets. In the case of digital heritage, which is made up of digital elements that should be preserved due to their cultural value, some challenges have arisen regarding their legal protection. One of these challenges is the lack of clarity about how the (...) elements that comprise it should be protected, giving rise to doubts about how intellectual property should help solve this conflict. This article presents the discussion regarding the protection of digital heritage in Colombia, how copyright is becoming an instrument that contributes to its legal protection, and the challenges to further develop it in the country. In this essay, I have rejected the inductive interpretation of the paradigm of contextual implication (to say “p”; is to imply that one believes that ) and proposed in its stead an explicatory model according to which a speaker in making a statement contextually implies whatever one is entitled to infer on the basis of the presumption that his act of stating is normal. In developing this model, I show how contextual implication depends on three distinct matters: a stating context, (...) presumptions of normality, and rules for the correct use of expressions. In the UK, current policies and services for people with mental disorders, including those with intellectual disabilities (ID), presume that these men and women can, do, and should, make decisions for themselves. The new Mental Capacity Act (England and Wales) 2005 (MCA) sets this presumption into statute, and codifies how decisions relating to health and welfare should be made for those adults judged unable to make one or more such decisions autonomously. The MCA uses a procedural checklist to guide this (...) process of substitute decision-making. The personal experiences of providing direct support to seven men and women with ID living in residential care, however, showed that substitute decision-making took two forms, depending on the type of decision to be made. The first process, ‘strategic substitute decision-making’, paralleled the MCA’s legal and ethical framework, whilst the second process, ‘relational substitute decision-making’, was markedly different from these statutory procedures. In this setting, ‘relational substitute decision-making’ underpinned everyday personal and social interventions connected with residents’ daily living, and was situated within a framework of interpersonal and interdependent care relationships. The implications of these findings for residential services and the implementation of the MCA are discussed. (shrink)

This book evaluates some of the most common ethical issues confronted by reproductive endocrinologists, embryologists, and their teams. The authors apply core ethical principles and approaches to problem solving to each of the cases raised. This work is a guide for both those on the front lines of patient care as well as for students in the field, whatever their background. By outlining sample cases, the book is an instigator for ethical discussions among ethicists, medical practitioners and students.

The neural correlates of software programming skills have been the target of an increasing number of studies in the past few years. Those studies focused on error-monitoring during software code inspection. Others have studied task-related cognitive load as measured by distinct neurophysiological measures. Most studies addressed only syntax errors. However, a recent functional MRI study suggested a pivotal role of the insula during error-monitoring when challenging deep-level analysis of code inspection was required. This raised the hypothesis that the insula is (...) causally involved in deep error-monitoring. To confirm this hypothesis, we carried out a new fMRI study where participants performed a deep source-code comprehension task that included error-monitoring to detect bugs in the code. The generality of our paradigm was enhanced by comparison with a variety of tasks related to text reading and bugless source-code understanding. Healthy adult programmers participated in this 3T fMRI experiment. The activation maps evoked by error-related events confirmed significant activations in the insula [p < 0.05]. Importantly, a posterior-to-anterior causality shift was observed concerning the role of the insula: in the absence of error, causal directions were mainly bottom-up, whereas, in their presence, the strong causal top-down effects from frontal regions, in particular, the anterior cingulate cortex was observed. Based on an extensive review of the literature and field surveys, the paper proposes a conceptualization and operationalization of corporate citizenship meaningful in two countries: the United States and France. A survey of 210 American and 120 French managers provides support for the proposed definition of corporate citizenship as a construct including the four correlated factors of economic, legal, ethical, and discretionary citizenship. The managerial implications of the research and directions for future research are discussed.

The present study tried to objectify the knowledge of LTE of healthcare personnel at an institute in Medellín using a self-administered survey that allowed conducting a cross-sectional descriptive study with non-probabilistic sampling. Within the results, 56.5 % of respondents understood the concept of LTE, and 90 % applied it actively. An innovative, multifaceted approach to scientific experiments as designed by and shaped through interaction with the modeling process The role of scientific modeling in mediation between theories and phenomena is a critical topic within the philosophy of science, touching on issues from climate modeling to synthetic models in biology, high energy particle physics, and cognitive sciences. Offering a radically new conception of the role of data in the scientific modeling process as well as a new awareness of the problematic aspects (...) of data, this cutting-edge volume offers a multifaceted view on experiments as designed and shaped in interaction with the modeling process. Contributors address such issues as the construction of models in conjunction with scientific experimentation; the status of measurement and the function of experiment in the identification of relevant parameters; how the phenomena under study are reconceived when accounted for by a model; and the interplay between experimenting, modeling, and simulation when results do not mesh. Experimental modeling is the construction of theoretical models hand in hand with experimental activity. As explained in Section 1, experimental modeling starts with claims about phenomena that use abstract concepts, concepts whose conditions of realization are not yet specified; and it ends with a concrete model of the phenomenon, a model that can be tested against data. This paper argues that this process from abstract concepts to concrete models involves judgments of relevance, which are irreducibly normative. In Section 2, we (...) show, on the basis of several case studies, how these judgments contribute to the determination of the conditions of realization of the abstract concepts and, at the same time, of the quantities that characterize the phenomenon under study. Then, in Section 3, we compare this view on modeling with other approaches that also have acknowledged the role of relevance judgments in science. To conclude, in Section 4, we discuss the possibility of a plurality of relevance judgments and introduce a distinction between locally and generally relevant factors. (shrink)

This book gives deliberation a dynamic dimension, analysing how levels of deliberation rise and fall in group discussions, and introducing the concept of 'deliberative transformative moments' and how they can be applied to deeply divided societies, where deliberation is most needed but also most difficult to work. Discussions between ex-guerrillas and ex-paramilitaries in (...) Colombia, Serbs and Bosnjaks in Bosnia-Herzegovina, and police officers and locals in Brazilian favelas are used as case studies, with participants addressing how peace can be attained in their countries. Allowing access to the records and transcripts of the discussions opens an opportunity for practitioners of conflict resolution to apply this research to their work in trouble spots of the world, creating a link between the theory and practice of deliberation. In group discussions of any kind there tends to be an up and down in the level of deliberation. To capture this dynamic we coined the concept of Deliberative Transformative Moments (DTM). In deeply divided societies deliberation is particularly important in order to arrive at peace and stability, but deliberation is also very difficult to be attained. Therefore, we wanted to learn about the conditions that in group discussions across the deep divisions of such societies help deliberation. We organized such (...) group discussions between ex-guerrillas and ex-paramilitaries in Colombia, Serbs and Bosnjaks in Srebrenica, and poor residents and local police officers in the favelas (slums) of Brazil. We could identify factors that help to transform discussions from low to high deliberation and risk transformations in the opposite direction. We could also identify factors that help to keep a discussion at a high level of deliberation, and, in a next step, we could determine to what extent long sequences of deliberation had a positive impact on the outcomes of the discussions. Finally, we show how our research results can have a long term effect if it is used in schools of such deeply divided societies. (shrink)

En este libro se han abordado algunos aspectos de la situación de Latinoamérica desde diversos enfoques. En ninguno de estos aspectos se ha pretendido ser exhaustivo, pero sí acercarse con una mirada crítica a los problemas que enfrenta Latinoamérica hoy, y que, en muchos sentidos, comprometen su futuro. Cuestiones tales como la multiculturalidad, la diversidad social, el resurgir del indigenismo, la construcción de los nuevos republicanismos y los procesos de revisión de las Constituciones democráticas, así como el desarrollo de una (...) ética pública, son extremos que afectan singularmente al desarrollo social y político de América Latina y son los temas tratados en este volumen. Sin embargo, no son estos los únicos problemas, también, emerge, con capacidad de generar conflicto, la integración panamericana que sigue, actualmente, vías diversas y contradictorias. Es obvio que estas contradicciones no contribuyen a favorecer el despliegue del liderazgo internacional de América Latina. De hecho, la integración y las formas de alcanzarla son terreno de controversia entre los diversos Estados latinoamericanos. Por otro lado, el mérito de este libro consiste en que todas las aportaciones se unen a la corriente crítica que, en la celebración del Bicentenario de las Independencias de Latinoamérica, se han esforzado por revisar dos procesos: el primero, la emancipación política de las nuevas naciones. Y en segundo lugar, el fracaso de esta emancipación con la aparición de la dependencia del subcontinente respecto de nuevos neoimperialismos, como sucede con el estadounidense. Además, se recogen aportaciones de autores que, si bien tienen en común su preocupación por reflexionar de modo crítico, parten de premisas no necesariamente coincidentes, poseen visiones diferentes y enfatizan cuestiones diversas. Ha contribuido a la diversidad de perspectivas el que los autores sean de continentes distintos y, por consiguiente, puedan afrontar los contextos sociales y políticos con miradas disímiles. In the philosophy of science, identity over time emerges as a central concern both as an ontological category in the interpretation of physical theories, and as an epistemological problem concerning the conditions of possibility of knowledge. In Reichenbach and subsequent writers on the problem of indistinguishable quantum particles we see the return of a contrast between Leibniz and Aquinas on the subject of individuation. The possibility of rejecting the principle of the identity of indiscernibles has certain logical difficulties, leading us (...) inexorably from ontology into epistemology. For the epistemological problem we attend to the differences that emerged between the (neo-)Kantian and logical empiricist traditions, also saliently displayed in Reichenbach's writings. After examining the contrast between Kant's and Leibniz's conceptions of empirical knowledge, specifically with respect to the irreducibility of spatiotemporal determinations, we explore an application of a neo-Kantian view to the same problem of indistinguishable quantum particles. Airway mucin secretion is important pathophysiologically and as a model of polarized epithelial regulated exocytosis. We find the trafficking protein, SNAP23, selectively expressed in secretory cells compared with ciliated and basal cells of airway epithelium by immunohistochemistry and FACS, suggesting that SNAP23 functions in regulated but not constitutive epithelial secretion. Heterozygous SNAP23 deletant mutant mice show spontaneous accumulation of intracellular mucin, indicating a defect in baseline secretion. However mucins are released from perfused tracheas of mutant and wild-type mice at the (...) same rate, suggesting that increased intracellular stores balance reduced release efficiency to yield a fully compensated baseline steady state. In contrast, acute stimulated release of intracellular mucin from mutant mice is impaired whether measured by a static imaging assay 5 min after exposure to the secretagogue ATP or by kinetic analysis of mucins released from perfused tracheas during the first 10 min of ATP exposure. Together, these data indicate that increased intracellular stores cannot fully compensate for the defect in release efficiency during intense stimulation. The lungs of mutant mice develop normally and clear bacteria and instilled polystyrene beads comparable to WT mice, consistent with these functions depending on baseline secretion that is fully compensated. The relevance of preschool children's understanding of nature, its elements, how it affects the behavior of human beings and how human being influences it, it helps to the identification of the necessary elements for the design of programs that have a significant impact in the development of environmental identity and the implementation of environmental education in the school curriculum in Mexico, in order to achieve the derivation of attitudes to preserve the environment from an early age. Under this logic, the (...) objective of the present study was to identify the components of the concept Nature, from drawings made by preschool children in a desert environment, this through a visual discursive analysis. It was made by 118 preschool students, whose ages range between 5 and 6 years; enrolled in four different schools in Hermosillo, Mexico, three located in the urban area and one on the coast of the State of Sonora. Participants were asked to draw the first thought that came to their minds when they heard the word nature. As a result, it was obtained with the representations of the images, that all the drawings present categories such as plants, animals, water bodies, celestial bodies, abiotic factors, natural locations, locations made by man and others. Finally, it was discovered that the analyzes showed a generalized idea of what nature represents by including elements of known flora and fauna, however, they did not capture elements of the desert region in which they live. Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)
